General Terms and Conditions (GTC) and Participation Conditions

for events of the Junior Golf Tour
Event: Junior golf tournaments
Organizer: Junior Golf Tour, Maximiliane Finger, Am Steinbach 28, 86529 Schrobenhausen, Germany
(hereinafter referred to as the “Organizer”)

 

1. General

1.1. These General Terms and Conditions (“GTC”) govern the conditions for participation in the events of the Organizer described above. Any deviating terms and conditions of the participant shall not apply.
1.2. The Organizer is entitled to amend or supplement these GTC if necessary. Changes shall take effect upon publication on the Organizer’s website at www.jgt24.de and shall apply to future bookings; for contracts already concluded, the GTC included at the time the contract was concluded shall apply.
1.3. The language of the contract is German. This English version is provided for convenience only. In the event of discrepancies, the German version shall prevail.

 

2. Registration and Conclusion of Contract

2.1. Registration for the events is carried out exclusively online. For this purpose, the Organizer provides access (redirect/link) on its website www.jgt24.de to an external platform (“Golfbox”) through which registration is processed. The technical processing of booking and payment is carried out via this platform, using the payment service provider Stripe. However, the contractual partner with regard to participation in the event is exclusively the Organizer.
2.2. The events presented on the website and in the booking platform constitute a binding offer by the Organizer to conclude a contract for participation in the respective event (service/event contract). The participant accepts this offer by completing the booking process in full and finalizing the payment process. Effective acceptance requires that the participant truthfully completes all mandatory fields of the booking form and confirms the validity of these GTC.
2.3. The contract for participation in the event is concluded as soon as the Organizer confirms the participant’s registration by email. Amendments or supplements to the concluded contract require text form (e.g., email) to be effective.
2.4. During the online booking process, the participant has the opportunity at any time to review and correct their entries using the usual browser and form functions. Prior to submitting the binding booking, all entries are displayed in a summary and can be reviewed again there and, if necessary, changed.
2.5. Booking processing and communication generally take place by email. The participant is responsible for providing a correct email address and ensuring that emails from the Organizer can be received (e.g., not filtered as spam).
2.6. For minor participants, the consent of the legal representative is required for submitting the registration and all related declarations of intent. Registration of minors may only be carried out by their legal guardians or with their express consent. In such cases, the contractual partner of the Organizer is the legal guardian(s).

 

3. Prices

3.1. The participation fee stated in the invoice is decisive and binding for the participant.
3.2. Where legally required, all prices include the applicable value added tax (VAT).
3.3. Any discounts or reductions will be indicated separately. If such reductions are not expressly stated, there is no entitlement to them. 

 

4. Payment

4.1. Payment of the participation fee is made via the payment methods offered on the “Golfbox” platform, using the payment service provider Stripe. The terms of use and/or business terms as well as the data protection provisions of Golfbox and Stripe also apply; these are specifically referenced during the booking process. The contractual partner with regard to the participation fee remains the Organizer.
4.2. If a payment is reversed/charged back (e.g., due to insufficient funds or incorrect information), the participant shall reimburse all damages and/or expenses incurred as a result. This includes, in particular, any bank charges as well as a processing fee of EUR 7.50 per reversal for processing by the Organizer. In the event of an unjustified credit card chargeback, a processing fee of EUR 20.00 will be charged. In the event of a reversal, the Organizer is entitled to withdraw from the contract with immediate effect; in this case, the participant loses their right to participate in the event. Further claims of the Organizer remain unaffected. The participant expressly retains the right to prove that no damage or a significantly lower damage was incurred by the Organizer.

 

5. Right of Withdrawal

5.1. The events offered by the Organizer are services in connection with leisure activities for which a specific date or period is provided. For such contracts, there is no statutory right of withdrawal pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB).
5.2. A statutory right of withdrawal is therefore not granted for booking the events. There is no additional contractual right of withdrawal. The option to withdraw from the contract is governed exclusively by the following cancellation conditions in Section 6.

 

6. Withdrawal / Cancellation by the Participant

6.1. If the participant is prevented from participating, they may withdraw from the contract. Withdrawal must be declared to the Organizer in writing or by email. The decisive factor is the time at which the withdrawal declaration is received by the Organizer. The registration deadline stated on the respective event page (“Registration Deadline”) applies as the closing date for entries.
The following cancellation conditions apply:
a) If the withdrawal is received by the Organizer no later than 30 days before the start of the event, the participation fee will be refunded, retaining a processing fee of 20%.
b) If the withdrawal occurs within the period from 29 days before the start of the event up to the Registration Deadline, the participation fee will be refunded, retaining a processing fee of 40%.
c) If the withdrawal occurs after the Registration Deadline, no refund will be made.

 

7. Services

7.1. The type and scope of the services owed by the Organizer result from the respective service description on the event website. In the event of deviations or contradictions, the service description reproduced in the invoice shall prevail.
7.2. Travel costs, accommodation, and catering costs are not included in the participation fee unless they are expressly stated as included in the respective event description. If the participant does not make use of offered services in whole or in part, there is no entitlement to a refund of the participation fee.

 

8. Cancellation of the Event by the Organizer

8.1. The Organizer is entitled to cancel the event for good cause, including at short notice. This also applies to accompanying framework or evening programs. Good cause includes, in particular, cases of force majeure, official orders, safety concerns, unforeseeable unplayability of the golf course, or other circumstances beyond the Organizer’s control that substantially impede or make it impossible to conduct the event.
8.2. In the event of cancellation, the Organizer will fully refund the participation fee paid by the participant within 14 days. Any further expenses or costs incurred by the participant, in particular for travel and accommodation, will not be reimbursed. Any claims for damages by the participant for wasted expenses exist only within the scope of the liability provisions under Section 10.

 

9. Photo, Film and Audio Recordings

9.1. During the event, the Organizer or third parties commissioned by the Organizer may create photo, film, or audio recordings. Recordings in which participants are identifiable will only be used or published by the Organizer for reporting or advertising purposes if separate, voluntary consent has been given in accordance with the applicable data protection regulations; such consent may be revoked at any time with effect for the future.
9.2. Participation in the event is not conditional upon granting such consent. Consent already given may be revoked at any time with effect for the future; the lawfulness of processing carried out up to the time of revocation remains unaffected.

 

10. Liability

10.1. The Organizer is liable without limitation for damages resulting from injury to life, body, or health that are based on an intentional or negligent breach of duty by the Organizer, its legal representatives, or vicarious agents. The same applies to other damages based on an intentional or grossly negligent breach of duty by the Organizer, its legal representatives, or vicarious agents.
10.2. For damages caused by simple negligence that do not concern life, body, or health, the Organizer shall only be liable if an essential contractual obligation (cardinal obligation) has been breached. Essential contractual obligations are obligations whose fulfillment enables the proper performance of the contract in the first place and on whose compliance the participant may regularly rely. In these cases, the Organizer’s liability is limited to the typical, foreseeable damage.
10.3. The above limitations of liability do not apply to claims under the German Product Liability Act (Produkthaftungsgesetz), to claims based on fraudulent conduct, or to claims arising from guarantees assumed.
10.4. Otherwise, the Organizer and its vicarious agents shall not be liable for disruptions or impairments of any kind caused by circumstances beyond their area of influence.
10.5. For damages arising in connection with travel to and from the event locations organized at the participant’s own responsibility, as well as for losses of items brought along, the Organizer shall only be liable in accordance with the provisions above; any further liability is excluded. Liability for damages resulting from injury to life, body, or health as well as for intent and gross negligence remains unaffected.

 

11. Participation of Minors / Supervision

11.1. The legal guardians must ensure that the minor participant is medically and physically able to take part in the event. The Organizer must be informed prior to the start of the event about relevant health impairments or special circumstances (e.g., chronic illnesses, allergies, regularly taken medication).
11.2. During the official event times, the Organizer and/or supervising staff engaged by the Organizer will provide supervision of minor participants to an appropriate extent. Responsibility for travel to and from the event and for times outside the officially announced event program lies exclusively with the legal guardians.
11.3. The Organizer is entitled to exclude participants from further participation who, despite prior warning, persistently violate instructions of the supervising staff, the course rules, or good morals to a significant extent, or who endanger other persons. In such a case, there is no entitlement to a refund of the participation fee; further claims for damages by the Organizer remain unaffected.

 

12. Final Provisions

12.1. The contractual relationship between the Organizer and the participant shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the participant is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Neuburg a.d. Donau, Germany. Otherwise, the statutory places of jurisdiction apply.
12.2. Should individual provisions of these GTC be wholly or partially invalid or later lose their validity, the validity of the remaining provisions shall remain unaffected. The same applies to any regulatory gaps.
12.3. The place of performance for all obligations arising from the contractual relationship is the Organizer’s registered office.

 

13. Data Protection

The Organizer processes participants’ personal data exclusively within the framework of applicable data protection regulations (in particular the GDPR and the German Federal Data Protection Act (BDSG)). Details on data processing, in particular on service providers used (e.g., Golfbox, Stripe), the purposes of processing, and the rights of data subjects, can be found in the Organizer’s privacy policy at: https://www.jgt24.de/en/privacy-policy
